If you commission construction work in South Africa, you have Construction Regulations duties — including for domestic extensions. Ignorance is no defence and Department of Employment and Labour prosecution carries unlimited fines.
When Construction Regulations applies
Construction Regulations 2014 applies to all construction work, including domestic. Domestic clients have most duties transferred to the contractor automatically, but only if a contractor exists.
Client duties
- Appoint a Principal Designer and Principal Contractor in writing (where more than one contractor is involved)
- Provide pre-construction information to designers and contractors
- Ensure adequate welfare facilities on site
- Ensure construction phase plan is in place before work starts
- Notify Department of Employment and Labour (DCOIDA) for projects longer than 30 days with 20+ workers, or 500+ person-days
For domestic clients
Most duties pass to:
- The Principal Contractor (or sole contractor) if appointed
- The Principal Designer if no contractor
You still need to appoint these in writing. Verbal agreements don't satisfy the regulations.
What the Principal Designer does
- Coordinates health and safety during design
- Identifies and reduces foreseeable risks
- Prepares Pre-Construction Information
- Prepares Health and Safety File at end of project
What the Principal Contractor does
- Plans, manages, and monitors the construction phase
- Liaises with the Principal Designer
- Prepares Construction Phase Plan
- Ensures site induction, briefings, and welfare
Section 30 notification notification
Larger projects must be notified to Department of Employment and Labour (DCOIDA) via the online Section 30 notification form before work starts. Penalties for failing to notify are significant. Your Principal Designer or Principal Contractor typically files this.
Welfare
Site welfare (toilets, washing, drinking water, rest facilities) is a hard legal requirement, not optional. "Use the bathroom in the house" is acceptable for domestic works only with the homeowner's express agreement and adequate provision.
