Planning Appeals: Process and Success Rates

A planning refusal isn't the end. About 30% of South African planning appeals succeed, more for some scheme types. Understanding the process — and whether to appeal or re-apply — can rescue a project that looks dead.

Appeal vs revised application

Two options after refusal:

  • Revised application: Address reasons for refusal, resubmit. Quicker but requires substantive design changes.
  • Appeal: Argue the original decision was wrong. Slower but no design change needed.

The three appeal procedures

Written representations

Both sides submit written statements. Inspector decides on the papers.

  • Fastest (3–6 months typical)
  • Cheapest
  • Used for most domestic and small commercial appeals

Hearing

Informal round-table discussion between parties and inspector.

  • Mid-length (6–9 months)
  • Useful where positions need clarifying through discussion

Public inquiry

Formal evidence and cross-examination.

  • Longest (9–18 months)
  • Most expensive
  • Used for major schemes, complex issues, or where reputation matters

Success rates

  • All appeals (overall): ~30%
  • Householder appeals: ~33%
  • Minor commercial: ~35%
  • Major (large housing): ~50%

Success rates have crept up slightly as housing pressure increases.

Costs

  • Written representations DIY: R0 (just time)
  • Written reps with planning consultant: R50,000–R160,000
  • Hearing with consultant + counsel: R160,000–R500,000
  • Inquiry: R500,000–R5,000,000+

Deadlines

  • Householder appeals: within 12 weeks of refusal
  • Other appeals: within 6 months of refusal

Common winning grounds

  • Refusal contradicts established planning policy
  • Refusal ignores adopted Spatial Development Framework (SDF)
  • Refusal cites design objections that aren't supported
  • Refusal uses generic neighbour objections without substance

When not to appeal

  • Refusal lists multiple substantive grounds you can't all defeat
  • Modest design change addresses concerns
  • Officer recommendation was for approval (council overruled at committee) — re-apply often successful
